Both are correct!

When mounted they use their spears in combat and the enemy have a -1 to their armour save if the Cossacks count as charging.

When they dismount they have to dismount in Open Order but the spears special rule only applies to infantry armed with spears that are in close formation.

That doesn't mean that they throw their spears away when they dismount it just means that there are no special rules which apply to their use.

If they didn't have the spears their number of dice in combat dismounted would probably be 1 just like the Moloitsy who are armed only with firearms.
